The Boutique Project - Terms of use and legal restrictions

ATTENTION: Please read these terms carefully before using this website.  Using this website indicates that you accept these terms.  If you (AKA "Customer") do not accept these terms, do not use this website ("site").

General

The Boutique Project LLC (TBP LLC) administers this Site from its location in Plattsmouth, Nebraska. Customers may not use the materials at this Site in violation of any applicable laws or regulations. These Terms will be governed by and construed in accordance with the laws of the State of Nebraska, without giving effect to any principles of conflicts of laws. TBP LLC may revise these Terms at any time by updating this posting. Customer should visit this page from time to time to review the then-current Terms because they are binding on Customer.

Prices, taxes and fees

Prior to submitting orders, Customer will have the opportunity to review product prices and any applied sales tax and shipping/handling fees. Please notify TBP LLC promptly of any errors in prices on a packing slip. TBP LLC reserves the right to change prices at any time.

Order acceptance, cancellation and returns

Order costs will be charged to Customer's account upon acceptance. TBP LLC reserves the right to decline or cancel orders at any time. Order confirmation or decline notification is via email to the email address provided by Customer when submitting the order. We assume no responsibility for issues resulting from such declines, cancellations or email notification failure.

TBP LLC begins processing accepted orders immediately and is therefore unable to accept order cancellation requests once an order confirmation has been sent. If an order is placed or processed in error, contact our Customer Service department immediately at questions@theboutiqueproject.com for instructions.  Due to the nature of our products (i.e. our inability to resell products that have been delivered to and potentially used by the recipient), we cannot accept returns for convenience.  However, please do contact our Customer Services department (questions@theboutiqueproject.com) regarding any order issues as other resolution options are often available to ensure Customer satisfaction.

Shipping

TBP LLC ships merchandise to street addresses within the 50 United States and the District of Columbia. We cannot ship to P.O. boxes, United States territories, or addresses outside the 50 United States and the District of Columbia. For Customer protection, a signature may be required for large deliveries. We typically cannot allow address changes after an order has been accepted. Customers may not export any products purchased at TBP LLC.

Incorrect address, non-deliverable and refused shipment policies
Orders that have been returned to us will be handled in a timely manner by our Customer Service department. If TBP LLC has made the error, we will re-send the shipment to the correct address at no cost to Customer. If Customer has made the address error, Customer will need to pay the cost of reshipping. Please note that due to the nature of most of our products (primarily classified as "cosmetics" per FDA regulations), we are unable to accept returns for convenience of delivered products.  For shipment refusals, Customer is responsible for any return shipping/handling charges, and a 15% disposal fee will be charged to the billing account provided by Customer at the time of order placement.  For order errors made by TBP LLC, please contact our Customer Service department immediately for resolution. Privacy policy
TBP LLC believes that confidential information should remain confidential within our company. We will never sell or share Customer personal information, email address, or order details with any other companies or individuals.

Disclaimers

TBP LLC's obligations with respect to its products are governed solely by the agreements under which they are provided and nothing on this Site should be construed to alter such agreements. TBP LLC further does not warrant the accuracy and completeness of the materials at this Site. TBP LLC may make changes to the materials and services at this Site, or to the products and prices described in them, at any time without notice.

The contents of our Site have not been evaluated by the FDA. Information on our Site is not intended to diagnose, treat, cure or prevent any disease. Always consult a medical doctor, or other alternative medical practitioner when suffering from any disease, illness, or injury before using TBP LLC products. READ ALL WARNING LABELS PRIOR TO PURCHASE AND USE (NOTE THAT WARNING LABELS FOR ALL PRODUCTS ARE POSTED ON THIS SITE FOR VIEWING PRIOR TO PURCHASE), and keep all products away from children except as stated on labels for use under adult supervision.

Limitation of liability

IN NO EVENT WILL TBP LLC, ITS SUPPLIERS, OR OTHER THIRD PARTIES MENTIONED AT THIS SITE BE LIABLE FOR ANY DAMAGES WHATSOEVER ARISING OUT OF THE USE, INABILITY TO USE, OR THE RESULTS OF USE OF THIS SITE, ANY WEBSITES LINKED TO THIS SITE, OR THE MATERIALS OR INFORMATION OR SERVICES CONTAINED AT ANY OR ALL SUCH SITES, WHETHER BASED ON WARRANTY, CONTRACT, TORT OR ANY OTHER LEGAL THEORY AND WHETHER OR NOT TBP LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF CUSTOMER'S USE OF THE MATERIALS, INFORMATION OR SERVICES FROM THIS SITE RESULTS IN LOSS, CUSTOMER ASSUMES ALL COSTS THEREOF.

Applicable law

By visiting this Site, Customer agrees that the laws of the state of Nebraska, without regard to principles of conflict of laws, will govern these terms of use and restrictions and any dispute of any sort that might arise between Customer and TBP LLC or its associates.

Disputes

Disputes relating in any way to Customer's visit to TBP LLC or to products Customer purchases through TBP LLC shall be submitted to confidential arbitration in Nebraska. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrators award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.
